Pilot Program Terms – Last updated: December 2024
1Introduction and Acceptance
These Terms of Service ("Terms") govern your access to and use of the RatingSolutions Pilot Program ("Pilot"), a 30-day free trial of our SaaS platform for hotel review management.
By registering for the Pilot via our website (ratings.solutions) or any linked form, you ("User" or "Customer") agree to these Terms on behalf of yourself and your organization (e.g., hotel or resort). If you do not agree, do not register or use the Pilot.
RatingSolutions is operated by Rating Solutions, with data processing in the EU (via Supabase and Vercel). These Terms incorporate our Privacy Policy and any Data Processing Agreement (DPA) for GDPR compliance.
2Pilot Program Description and Access
Services Provided
During the Pilot, you receive full access to core features, including QR-based feedback collection, rule-based routing (positive reviews to Google/Booking/Tripadvisor, negative internally), dashboard analytics, AI sentiment analysis (via EU-based models), and deletion support for invalid reviews (in compliance with platform guidelines).
Trial Period
The Pilot lasts 30 days from registration, with no credit card required. It is risk-free and can be canceled anytime via email to contact@ratings.solutions.
Eligibility
Limited to middle-sized hotels/resorts (e.g., 80+ rooms). We reserve the right to approve or deny access.
Setup and Onboarding
Upon registration, we provide Magic-Link access, printable QR templates, and a step-by-step guide (PDF/video) via email. No on-site visit is required; setup is self-service, with optional remote support via WhatsApp/Email.
3User Obligations and Acceptable Use
Your Responsibilities
Provide accurate information during registration (e.g., hotel name, contact, platforms to optimize). Use the Pilot only for legitimate hotel review management. Do not misuse the service (e.g., spam feedback requests, violate platform rules, or share access credentials).
Acceptable Use Policy
Prohibited: Illegal activities, reverse engineering, or using the service to harm others (e.g., fake reviews). You must comply with GDPR and local laws. Report any issues promptly.
Platform Links
During registration, you may optionally select platforms (e.g., Google, Booking, Tripadvisor) and provide URLs for optimization – we use these for API syncing but do not store sensitive data beyond necessary.
4Data Privacy and Security
Data Processing
We process guest feedback and review data as a processor under GDPR (EU infrastructure). Authentication is passwordless (Magic-Link). We access platforms via official APIs only. Deletion support follows platform policies; we do not guarantee removals.
Retention and Deletion
Feedback data is stored for the Pilot duration + 30 days post-termination. You can request deletion anytime.
Compliance
A full DPA will be provided upon request. Our Privacy Policy details API usage, AI processing (e.g., sentiment clustering), and data flows. No passwords are stored; all processing is EU-based for compliance.
5Intellectual Property
Our Rights
RatingSolutions, including software, dashboards, and AI models, is our proprietary IP. You receive a limited, non-exclusive license for Pilot use only. Do not copy, modify, or distribute.
Your Data
You retain ownership of your hotel data and feedback. We may use anonymized aggregates for service improvement (e.g., benchmarks), with your consent where required.
6Limitations of Liability and Disclaimers
No Warranties
The Pilot is provided "as is" without warranties. We do not guarantee review deletions, score improvements, or uninterrupted service.
Liability Cap
Our liability is limited to direct damages, capped at €100. No liability for indirect losses (e.g., lost bookings) or third-party actions (e.g., platform changes).
Indemnification
You indemnify us against claims from your misuse (e.g., violating platform rules).
7Termination and Post-Pilot
Termination
We may terminate the Pilot anytime (e.g., for misuse). You can cancel via email. Upon end, access stops; data is deleted per retention policy.
Transition
After 30 days, you may upgrade to paid plans (starting at €29.90/month). Non-upgrade leads to automatic termination.
8Governing Law and Dispute Resolution
Applicable Law
Governed by German law; EU GDPR applies. Disputes resolved in Munich courts.
Changes
We may update Terms; continued use implies acceptance. Notifications via email.
